Incorporation of Section 8 Company

Section 8 companies are a legal form for Non Profit Organization (NPO). Such a company is incorporated for the promotion of commerce, art, science, education, research, sports, charity, social welfare, religion, protection of environment or any such other object.

A section 8 company shall have to apply all its profits, income, or other earnings, in promoting the objects for which it has been formed. Section 8 company Pays no dividend or income to its members.

These are limited companies, registered under the Companies Act, 2013. Section 8 companies are not required to add word “limited” to their name.

Registration of Trust

A trust is a consensus between two people called trustees, in order to manage some property for a humanitarian purpose.

A trust deed need to be executed and registered in order to form a Trust. It is important that any trust deed is to be created on appropriate value of non-judicial stamp paper based on the rate of stamp duty applicable in concerned state. Secondly,  based on the registered office of the trust jurisdiction, trust needs to be registered  with the sub-registrar office, along with the government registration fee.
